this means that he gives them a special force: evidential and enforceability.<\/p>\n<p>The preparation of a notarial deed is complex:<\/p>\n<ul>\n<li>First of all, the notary receives the private parties who approach him, gives his opinion and proposes solutions, guides the parties concerned in making their choice, analyses with them the civil and tax consequences of the various solutions, and calculates the costs associated with the transaction.<\/li>\n<li>When the parties have made their decision, it gathers the information and collects the necessary administrative information.<\/li>\n<li>The notary drafts the document and sends the parties a draft of the document.<\/li>\n<li>The notary approves the document by explaining it to the parties, certifying their supplementary statements and collecting their signatures before signing it himself. By approving the documents, the notary is liable.<\/li>\n<li>He takes care of the processing of subsequent formalities (transmission to the registers, ...).<\/li>\n<li>He keeps the documents in his notary's office.<\/li>\n<\/ul>\n<p>A notarial deed is necessary for certain transactions.<\/p>\n<p><strong>The private agreements<\/strong><br \/>\nA notarial deed is not always necessary. Sometimes, at the request of the parties, the notary draws up a document which he does not sign himself: for example, a simple loan agreement between private individuals. It is then a private agreement which does not offer the same guarantees as a notarial deed. However, it is not subject to the same formalities and does not entail the same costs.<\/p>\n<p><strong>Inheritance clearances<\/strong><br \/>\nThe liquidation of an inheritance is traditionally entrusted to notaries. He is often consulted for the preparation of a will. When a person dies, he contacts the heirs, provides the information relating to the acceptance or refusal of the inheritance, ensures that the heirs can become the owners of the assets, distributes the inheritance and takes care of the tax declaration. In case of unilateral dissolution, a prior invitation of the other party through a bailiff is required, and after three months it can be completed. The dissolution shall take effect from the date of deposit of the relevant document at the competent registry office.
